What Inerica Systems collects, why we collect it, how long we keep it, and how to ask us to delete it. Covers the website, the client portal and Erica.
On this page
1. Who we are
Inerica Systems ("we," "our," or "us") is a digital agency based in Berkeley, CA, providing website design, digital marketing, workflow automation, and AI integration services to Bay Area businesses. Our website is inericasystems.com and you can reach us at admin@inericasystems.com.
2. Information we collect
We collect information you provide directly to us, including:
- Contact information — name, email address, phone number, and business name when you fill out our contact form or request a free audit.
- Website URL — when you submit your site for an SEO audit.
- Communications — messages you send us via email or our contact form.
- Usage data — pages visited, time on site, and browser/device type, collected via analytics tools.
3. How we use your information
We use collected information to:
- Respond to your inquiries and provide our services.
- Send you your free audit report and follow-up communications.
- Send periodic marketing emails if you have subscribed (you may unsubscribe anytime).
- Improve our website and service offerings.
- Comply with legal obligations.
We do not sell or rent your personal information, and we do not disclose it to third parties for those third parties’ own marketing.
Mobile phone numbers and SMS consent are never shared or sold to third parties or affiliates for marketing purposes. A number you give us is used for the inquiry you made and for the messaging program you agreed to, and it reaches our messaging carrier only so that a message can be delivered. Consent to be texted is never a condition of purchase, and it is a separate decision from any other permission on this site. See the SMS terms.
4. Cookies & tracking
Our website uses cookies and similar technologies to understand how visitors interact with our site. These include session cookies (deleted when you close your browser) and persistent cookies (remain on your device). You may disable cookies in your browser settings; however, some features of our site may not function properly.
4a. SMS messaging
If you opt in to text messages from Inerica Systems Account Notifications, we use your mobile number only to send the account notifications you agreed to: onboarding and go-live scheduling, service and system update alerts, appointment reminders, billing and renewal notices, replies to support requests you opened. We do not send marketing messages through this program. Consent to receive texts is not a condition of purchase. You can still work with us without opting in. Message frequency varies. Message and data rates may apply. Reply STOP at any time. You will receive one confirmation message and no further texts. For help, reply help, or email helpdesk@inericasystems.com. Carriers are not liable for delayed or undelivered messages.
We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes. Mobile opt-in data and consent are not shared with any third parties or affiliates for marketing or promotional purposes. Mobile information may be shared only with the service providers that help us deliver messages — for example our telecommunications provider — and only for that purpose.
We keep a record of your opt-in — the date, time and source of consent, and the wording you agreed to — and of any opt-out request, for as long as the law requires us to be able to produce it. You can opt in or out at any time at our onboarding form or by replying STOP to any message.
5. Third-party services
These companies process data on our behalf so that the product works. Every one of them corresponds to a credential this platform manages and a code path that uses it — this is the real list, not a list of logos.
| Who | What for | What reaches them |
|---|---|---|
| Anthropic | The reasoning behind Erica — drafting, triage, summarizing. | The text of a prompt and the content it is asked to work on. |
| Google (Gemini) | A fallback model when the primary one is unavailable. | The text of a prompt and the content it is asked to work on. |
| ElevenLabs | Voice agents and spoken messages inside workflows. | The text to be spoken, and call audio where a voice agent is used. |
| Twilio | SMS, WhatsApp and voice. | Phone numbers, message content, call metadata. |
| Stripe | Subscription billing. | Billing contact and payment details. Card numbers go to Stripe directly and are never stored by us. |
| Elavon | Card-present payments at a point of sale, where a client uses one. | Transaction records. Card data is handled by the terminal and the processor. |
| n8n | The automation engine that runs client workflows. | Whatever a given workflow moves — typically lead and job records. |
| Meta | Advertising, for clients who buy ads through us. | Campaign and conversion data for that client's own ad account. |
| Google Ads | Advertising, for clients who buy ads through us. | Campaign and conversion data for that client's own ad account. |
| Google Analytics | Counting visits to this site and to client sites that use it. | Page views, referrer, coarse location, a device identifier. Only with consent. |
| RingCentral | Business telephony and SMS on a client's own number. | Phone numbers, call metadata, message content, call recordings where enabled. |
| Hostinger | The server the platform and client sites run on, and domain DNS. | Everything stored on the server, at rest. Hostinger does not access it in the ordinary course. |
| Neon | Managed PostgreSQL — the platform's primary database. | Client records, leads, jobs, invoices, configuration. |
| MongoDB Atlas | Managed database for certain client applications. | That client's operational records — leads, orders, applicants. |
| Sentry | Error reporting, so a fault is found before a customer reports it. | Stack traces and request context. Configured to scrub personal data from payloads. |
We also use a hosting provider and an analytics provider for this website itself. Each company above has its own privacy policy, linked from its name.
We have never sold personal information and we do not intend to. We do advertise, though, and we should be precise about what that means rather than leave you to discover it. If you allow the advertising cookie categories, an identifier is passed to Google and Meta so we can tell which advertising produced a visit, and so we can show you our ads again elsewhere. Under California law that can count as sharing for cross-context behavioral advertising even though no money changes hands.
Nothing in that category runs until you choose it — advertising and analytics tags are denied by default. You can switch them off at any time from Cookie preferences in the footer, which is also our Do Not Sell or Share My Personal Information control, and we honor the Global Privacy Control browser signal as an instruction to keep it off. Full detail on the cookies & tracking page.
This is separate from, and does not affect, the commitment above about mobile numbers: those are never shared for marketing, with or without a cookie choice.
5a. Artificial intelligence
Erica, our assistant, is software. It is labelled as software everywhere it speaks, and it is never presented as a person.
- What you type to Erica is sent to our AI providers so a reply can be generated. The conversation is kept for 1 day after the last message so Erica can follow it; if you ask for a person, what you wrote becomes an inquiry and is kept as one (24 months from last contact).
- We do not use your conversations to train foundation models, and our providers are engaged under terms that do not permit them to either.
- Erica does not make decisions with a legal or similarly significant effect on anybody. A person decides whether to take on work, what to charge and what to build.
- Ask for a person at any point and you get one. There is a phone number in the assistant for exactly that.
6. Data Retention
We retain your personal data only for as long as necessary to fulfill the purpose for which it was collected, or as required by law. Contact form submissions are retained for 24 months from last contact, as set out in our data retention schedule. You may request deletion of your data at any time by emailing admin@inericasystems.com.
7. Your rights
You have the right to:
- Access the personal data we hold about you.
- Request correction of inaccurate data.
- Request deletion of your data ("right to be forgotten").
- Opt out of marketing communications at any time.
- Lodge a complaint with your local data protection authority.
8. Security
We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. Our website uses HTTPS encryption for all data in transit.
9. Children's privacy
Our services are not directed to individuals under 13 years of age. We do not knowingly collect personal information from children. If you believe we have inadvertently collected such information, please contact us immediately.
10. Changes to this policy
We may update this Privacy Policy from time to time. We will notify you of significant changes by posting the new policy on this page and updating the "Last updated" date. Continued use of our website after changes constitutes acceptance of the updated policy.
11. Contact us
